POPIA Policy

1. Our Commitment to POPIA
Kreativworx (Pty) Ltd, trading as WA Automation, is fully committed to complying with the Protection of Personal Information Act 4 of 2013 (POPIA). This policy outlines our approach to responsible information governance.

3. The Eight Conditions for Lawful Processing
We process personal information in accordance with POPIA's eight conditions:
Condition 1 — Accountability: We take full responsibility for all personal information under our control.
Condition 2 — Processing Limitation: We only collect information that is adequate, relevant, and not excessive for our purposes.
Condition 3 — Purpose Specification: Personal information is collected for specific, explicitly defined purposes.
Condition 4 — Further Processing Limitation: We do not use personal information for purposes incompatible with the original purpose.
Condition 5 — Information Quality: We take reasonable steps to ensure information is accurate and up to date.
Condition 6 — Openness: We are transparent about our information processing activities.
Condition 7 — Security Safeguards: We implement appropriate security measures to protect personal information.
Condition 8 — Data Subject Participation: We respect and facilitate data subject rights.
4. Data Subject Rights
Under POPIA, you have the right to:
- Access your personal information held by us
- Request correction of inaccurate information
- Request deletion of your personal information
- Object to the processing of your personal information
- Lodge a complaint with the Information Regulator
- Be notified of security compromises

5. Direct Marketing Compliance
In compliance with POPIA Section 69 and the Information Regulator's December 2024 Guidance Note:
- We only send electronic marketing communications to data subjects who have opted in
- All marketing communications clearly identify WA Automation
- Every communication includes a clear opt-out mechanism
- Opt-out requests are processed immediately and recorded
- We maintain a suppression list of opted-out contacts
6. Security Measures
We maintain the following security safeguards:
- Encrypted data transmission (HTTPS/SSL)
- Role-based access controls
- Regular security reviews
- Staff confidentiality agreements
- Incident response procedures
7. Breach Notification
In the event of a data breach, we will:
- Notify affected data subjects as soon as reasonably possible
- Report to the Information Regulator as required
- Take immediate steps to contain and remediate the breach
- Document the breach and our response
8. Complaints Process
If you believe we have violated your rights under POPIA:

- We will resolve your complaint within 30 days
