Terms and Conditions

1. Acceptance of Terms

By accessing or using the WA Automation platform (waautomation.co.za), operated by Kreativworx (Pty) Ltd ("WA Automation", "we", "us"), you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the platform.

2. Platform Description

WA Automation is a South African business visibility platform that allows businesses to create listing profiles, be discovered by potential customers, and receive enquiries via WhatsApp. The platform also provides digital marketing, WhatsApp automation, and lead generation services.

3. User Accounts and Business Listings

3.1 Registration

To create a business listing, you must provide accurate and complete information. You are responsible for maintaining the accuracy of your listing at all times.

3.2 Listing Approval

All business listings are subject to review and approval by WA Automation before being published. We reserve the right to reject or remove any listing that violates these terms, contains false information, or is inappropriate.

3.3 Free 90-Day Visibility Programme

The free visibility listing is valid for 90 days from the date of approval. After 90 days, the listing will expire and must be upgraded to a paid package to remain visible on the platform.

3.4 Business Owner Responsibilities

You are responsible for:

• Ensuring all business information is accurate and up to date
• Responding promptly to customer enquiries received via WhatsApp
• Maintaining a professional standard of service
• Not misrepresenting your business, qualifications, or services
• Keeping your WhatsApp number active and accessible

4. Prohibited Content and Conduct

You may not use the platform to:

• Post false, misleading, or fraudulent information
• Impersonate another business or person
• Post illegal, defamatory, or harmful content
• Spam or send unsolicited communications
• Attempt to circumvent platform security measures
• List businesses that engage in illegal activities
• Violate any applicable South African law

5. Intellectual Property

All content on the WA Automation platform, including the logo, design, and platform code, is the intellectual property of Kreativworx (Pty) Ltd. Business owners retain ownership of their own content (logos, images, descriptions) but grant WA Automation a non-exclusive licence to display this content on the platform.

6. Payment Terms

• All prices are quoted in South African Rand (ZAR) and exclude VAT unless stated
• Monthly subscriptions are billed in advance
• Once-off setup fees are non-refundable
• Failed payments may result in suspension of your listing
• We use Netcash for payment processing — their terms apply to payment transactions

7. Cancellation and Refunds

• Monthly subscriptions may be cancelled with 30 days written notice
• No refunds are provided for partial months
• Once-off setup fees are non-refundable
• Free listings may be removed at any time without notice if they violate these terms

8. Limitation of Liability

WA Automation provides the platform on an "as is" basis. We do not guarantee:

• Specific levels of enquiries or leads
• Uninterrupted platform availability
• The accuracy of information provided by third-party businesses

To the maximum extent permitted by South African law, WA Automation's liability is limited to the monthly subscription fee paid in the month the issue arose.

9. Consumer Protection Act Compliance

These terms comply with the Consumer Protection Act 68 of 2008. South African consumers have the right to cancel fixed-term agreements with 20 business days notice. Any cancellation penalty will not exceed a reasonable amount as defined by the CPA.

10. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes will be resolved in the courts of South Africa.

11. Changes to Terms

We reserve the right to update these terms at any time. Changes will be communicated via email or WhatsApp with 30 days notice for material changes.
